ONGROUP Sp. z o.o., located at ul. Chrobrego 35, 62-200 Gniezno, Poland, NIP: 7842518652 (“we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Vimeria mobile application (the “App”).

Please read this Privacy Policy carefully. If you do not agree with the terms of this privacy policy, please do not access the App.

Information We Collect

• User-Provided Content: When you use Vimeria to edit photos or generate videos, we collect the photos, images, and prompts you provide (“Input”).
• Social Media and Third-Party Logins: We allow you to create an account and log in using email or third-party services (such as Google, Facebook, and Apple). If you choose to register or log in using these services, we will receive certain profile information about you from the third-party provider, which typically includes your name, email address, and profile picture. We use this information solely to manage your account and provide the Service.
• Usage Data: We automatically collect certain information when you access the App, including your device’s Internet Protocol (IP) address, device type, operating system, and App usage statistics (e.g., crash logs).
• In-App Purchases: If you purchase a subscription, the transaction is handled by Apple or Google. We do not collect or store your credit card information.

How We Use Your Information

We use the information we collect primarily to provide and improve our AI editing and generation services.

• AI Training Disclaimer: We DO NOT use your personal photos or generated videos to train, improve, or fine-tune our or fal.ai’s fundamental artificial intelligence models. Your images are used solely to generate the specific edit you requested.

Photos and AI Processing

What we collect. When you use Vimeria’s creation features (Image to Video, Edit Photo, Memorial Portrait), we collect the photos you choose to upload and the text instructions (prompts) you provide. We only receive photos you explicitly select; we never scan your photo library.

How we use it. Your photo and instructions are uploaded to Vimeria’s servers and shared with our third-party AI service provider, fal.ai, for the sole purpose of generating the video or image you requested. We do not use your photos for advertising, profiling, or to train our own AI models.

Who we share it with. fal.ai processes your photo and prompt on our behalf under a data processing agreement and does not retain or use your content for its own purposes, including model training. We require all processors to provide the same or equal protection of your data as described in this policy. We never sell your photos or share them with any other third party.

Where it is stored and for how long. Uploaded photos and generated content are stored with our hosting provider, OVHcloud, on servers located in the European Union. Uploaded source photos are automatically deleted within 7 days after processing. Generated content remains in your gallery until you delete it or delete your account.

Face Data

Photos you upload may contain images of faces. Vimeria does not collect, store, or process biometric identifiers: we do not create faceprints or facial geometry templates, and we do not use face recognition to identify anyone. Face imagery contained in your photos is used exclusively to generate the content you requested (for example, animating your photo or creating a memorial portrait), is shared only with fal.ai for that single purpose, and is stored and deleted on the same schedule as the photos themselves: source photos are deleted within 7 days after processing, and generated content is kept until you delete it or your account. Deleting your account immediately and permanently removes all photos, including any face imagery.

Data Retention

Uploaded source photos (the originals you upload) are automatically deleted from our servers within 7 days after processing. Generated content (the images and videos created for you) is stored so you can access it within the App, and is retained for as long as you choose to keep it in your account. When you delete a photo or video within the App, or if you delete your entire account, the associated files are permanently and irreversibly removed from our active servers. Certain records, such as purchase invoices, may be retained where required by law (see Account Deletion).

Sharing Your Information

We may share your information with third-party service providers that perform services for us or on our behalf, including:

• Hosting: OVHcloud, on servers located in the European Union.
• AI processing: fal.ai, which processes your photos and prompts solely to generate the content you requested.

These third parties are bound by strict confidentiality agreements and are permitted to use your data only to provide services to us. We do not sell your personal data to third parties.

Your Privacy Rights and Account Deletion

Depending on your location, you may have certain rights regarding your personal information:

• Account Deletion: You have the right to delete your account and associated content at any time, directly within the App (Profile → Delete account and all materials) or by contacting us at contact@vimeria.ai. See the Account Deletion section below for exactly what is removed and what may be retained.
• EU Users (GDPR): You have the right to access, rectify, or erase your personal data, and to restrict or object to our processing.
• California Residents (CCPA/CPRA): You have the right to request access to the specific pieces of personal information we have collected about you, the right to request deletion, and the right to opt-out of the “sale” or “sharing” of personal information (Note: We do not sell your personal data).
• Canada (PIPEDA): You have the right to access the personal information we hold about you and to request corrections.

Account Deletion

You can permanently delete your account at any time directly in the app: Profile → Delete account and all materials. Deletion immediately removes your account, remaining token balance, uploaded photos, and all generated content. You can also request deletion at contact@vimeria.ai. Records of purchases may be retained where required by law, in a form not linked to your identity.

Data Security

We use administrative, technical, and physical security measures to help protect your personal information. However, no data transmission over the Internet or wireless network can be guaranteed to be 100% secure.

Children’s Privacy

The App is not intended for children under the age of 13 (or 16 in certain EU jurisdictions). We do not knowingly collect personal identifiable information from children. If we learn we have collected such information, we will delete it immediately.
